The Appellate Division of Supreme Court yesterday by an order permitted Moidul Islam, Joint Secretary General of JP (Ershad) to prefer appeal against the High Courts judgement directing the Election Commission to allocate the symbol 'plough' to Motassim Billah, JP (Mizan) candidate for the by-election in Meherpur-1 constituency.

The Court also extended the order staying operation of the HC judgement till disposal of the appeal.

However, the election was held yesterday and Motassim Billah boycotted the election following the EC's refusal to postpone the election till disposal of the appeal.

On the same day Moidul Islam obtained an order of stay of HCjudgement.

The Appellate Division on May 2 extended the order of stay till May 4 and fixed for hearing of the petition for leave to appeal.

Barrister Rafique-ul Hoque moved for Moidul Islam, while Advocate-on-Record Sharifud-din Chaklader represented Mo-tassim Billah.
